Dozens of carmakers face allegations that they have been cheating emissions tests. They all strenuously deny that they have done anything wrong, with many stating their position that they have not broken the law at all. Some say that they have deployed technology or software that is allowable within the law, and others dispute the existence of anything that is designed for cheating emissions tests.
The whole “Dieselgate” scandal started with Volkswagen back in September 2015, when allegations emerged that they had deployed technology that could amount to a defeat device. They spent years strongly disputing the claims that had been made against them, including for tens of thousands of people pursuing damages against them here in England and Wales. Despite their strenuous denials, they settled tens of thousands of compensation claims earlier this year, and we expect that other carmakers may follow suit.
Whether different carmakers have been cheating emissions tests or not is very much something that has to be looked at on a case-by-case basis for each brand. The allegations are not all the same for each vehicle manufacturer, and it may well be that some have legitimate defences. However, what we intend to do is leave no stone unturned in our efforts to get to the truth as to whether any carmaker should be issuing damages for any behaviour that breaks the law.
We believe that other carmakers have been responsible for cheating emissions tests, and we will continue to pursue all legal actions to get to the truth.
If you own a lease, or previously owned or leased, a diesel vehicle over the last decade or so, you could be entitled to pursue your emissions compensation claim now.
The above is the very rough criteria to be able to pursue a case, but whether you can or not may depend on a number of factors, including the make and model of your vehicle. The best thing to do is complete a few forms on our website here now to find out if you are eligible to pursue a case. If you are, you can join our emissions actions and benefit from our No Win, No Fee legal representation.
We have been fighting for the rights of emissions claimants since the very start, when the first “Dieselgate” scandal emerged in September 2015. Unlike other firms who did not get involved in things until much later, or who simply accepted registrations of interest, we were pursuing real No Win, No Fee claims right from the start. We were the first law firm in England and Wales to issue High Court proceedings against VW in January 2016, and we were later appointed to the steering committee responsible for the overall conduct of the litigation.
We represent thousands of people in England and Wales, and we continue to play a pivotal role in holding any carmaker to account where they have engaged in behaviour to cheat emissions testing.
