When we launched our legal campaign and compensation action for the 2015 Volkswagen Dieselgate scandal, we knew it was only a matter of time before other carmakers were accused of similar behaviour. So far, a formal recall has not been initiated in the UK, but there has been action taken across the globe. If it is found that the companies have used defeat device technology for cheating emissions tests to bypass NOx regulations, we will make sure that they are brought to justice.
So far, Nissan and Renault (part of the Renault–Nissan–Mitsubishi Alliance) strongly refute that they have used any form of defeat device technology for cheating emissions tests. However, independent testing and information from the Department for Transport has reportedly indicated that there are discrepancies between NOx emissions in testing environments and in real-wold driving conditions. It may be that vehicles are emitting more than 15-times dangerous NOx than they ought to be and are in breach of EU emissions regulations.
It is also understood that Nissan had been previously asked to modify designs but this did not take place.
In 2017, they were found guilty in South Korea over the use of defeat devices and recalls were initiated after the country banned the sale of models from several carmakers. Models affected included 1.6-litre Renault vehicles and the British-built Qashqai SUV, as sold in South Korea. As a result, millions of pounds in fines were issued.
However, as far back as 2016 we were aware of the potential that Nissan and Renault may have been involved in similar behaviour to Volkswagen. It appears that Volkswagen likely used defeat device technology as they were unable to ensure their vehicles were compliant without sacrificing performance, so it makes sense that other carmakers will have faced the same struggles. This is not an acceptable excuse for cheating emissions tests and, if it is found that Nissan and Renault have used technology that amounts to a defeat device, we will hold them to account.
It is important to recognise that the full extent of Nissan and Renault models involved in any emissions scandal where defeat devices may have been used for cheating NOx tests has yet to be confirmed. Both diesel and petrol vehicles may be affected, and we could be talking about over 1.4 million vehicles affected in the UK alone.
So far, data indicates that vehicles manufactured between 2009 and 2018 may be affected. This may include models such as:
If your vehicle has been subject to an emissions recall and has had any changes, so-called ‘technical measures’ applied, or any form of ‘software update’ applied then you could be affected.

In the VW case, software was used to allow emissions reduction technology to engage when vehicles were being tested. Outside test conditions, emissions controls were not engaged which allowed vehicles to pollute far more dangerous NOx than they should have been doing. If it is established that Nissan and Renault have also been cheating emissions tests, owners could be entitled to thousands of pounds in compensation.
Although petrol vehicles generally produce far less NOx than diesel models, it is understood that petrol vehicles may also be affected by emissions irregularities. As far back as 2016 there have been reports that Nissan petrol vehicles may have been subject to data manipulation relating to emissions, with Mitsubishi Motors (part of the Renault–Nissan–Mitsubishi Alliance) reportedly admitting to the falsification of data following internal investigations. As such, we are not surprised to see that petrol vehicles may be involved in emissions cheating given that issues have been raised over four years ago.
In 2017, a leaked report in France reportedly indicated that “fraudulent strategies” had been used by Renault to distort results for 25 years for both diesel and petrol vehicles.
