Lower Saxony is Volkswagen’s second largest shareholder, and reportedly has no plans to sue the German carmaker for damages following the emissions scandal. Lower Saxony has a veto power on Volkswagen’s supervisory board and has a fifth of voting rights as well.
Prime Minister Stephan Weil believes there is currently no legal basis to make a claim, so “as a result there are no plans for a lawsuit.”
This news came not long after the state of Bavaria announced they will be suing Volkswagen, making them the first regional government in the home country of Volkswagen to make a claim.
The German carmakers are offering its affected U.S. car owners up to $10,000 each in compensation after it was discovered that Volkswagen diesel cars were fitted with software that could cheat emissions tests. However, Volkswagen are refusing to offer a monetary form of compensation to EU customers, and are instead just recalling EU cars and rectifying the problem.
The European Commission is opposed to Volkswagen only compensating U.S. customers and warns of further damage to the company’s reputation by failing to compensate EU customers as well.
Although we don’t really know anything about German law, we’re confident in being able to say that we firmly believe there is a clear legal basis for claims to be made here in the UK, and we plan to fight them all the way!
Legal action
Bavaria is one of many to join to group who are taking legal action against Volkswagen including South Korea and the United States. The United States recently received a settlement proposal of $15 billion for U.S. customers.
