About the Mercedes emissions recall

The Mercedes emissions recall actions have been ongoing over the last few years but gained increased momentum after a key court ruling in Germany in 2018. The German Federal Motor Transport Authority (KBA) ordered a mandatory recall of Mercedes-Benz diesel vehicles in Europe, with some 670,000 vehicles understood to be affected.

The recall that started in 2017 is understood to affect over 3 million vehicles in total.

The recall is understood to involve dozens of models with Daimler applying software updates in relation to emissions irregularities. It is alleged that the carmaker has used “defeat device” technology like VW had done which triggered the original dieselgate emissions scandal in 2015.

Changes applied as part of the recall should eliminate any alleged defeat device that may be resulting in vehicles emitting far more dangerous NOx than they ought to be doing. As we know from the VW action where we have represented over 10,000 claimants and were appointed with a seat on the Steering Committee in 2018, recall changes can have an adverse impact on the vehicles. We conducted extensive research from our significant Volkswagen client base and found many instances where vehicle performances were worse after the recall had been applied. If this is also the case in for the Daimler recalls, we may be able to take this into account for the compensation action we have launched.

About the compensation action
