A top EU court has reportedly ruled that illegal defeat devices were used in certain conditions in relation to Volkswagen vehicles in Europe.
This ruling is one that we would expect given that there have been similar rulings in courts around the world and, indeed, given that there have been rulings in the UK and settlements that have taken place here already. A Volkswagen emission settlement has finally been reached in England and Wales for tens of thousands of people taking part in the legal action.

Allegations of diesel emissions fraud have long been investigated in Europe following the revelation that Volkswagen had been manipulating emissions controls in its vehicles, cheating regulations. As the EU issues fines for emissions scandal culprits such as VW and BMW, questions have been raised about the impact on the wider car manufacturing industry and who else may also be involved in similar behaviour.
VW and BMW have been singled out in a recent antitrust investigation by the European Commission over claims that they had colluded with Daimler, the owner of the Mercedes-Benz brand. According to The Guardian, this was in relation to delaying the development of “emissions-cleaning technology” in their vehicles. Now, upon the conclusion of the investigation, the two companies have reportedly been hit with a total fine of €875m.
The findings of the investigation suggest that the three companies acted unlawfully. Many other well-known car brands have similarly been levelled with accusations of emissions fraud in the wake of the Volkswagen emissions scandal, so the conclusion of this EU investigation could be a sign of further penalties to come.
In 2015, Volkswagen hit the headlines in the infamous “dieselgate” scandal, in which the carmaker was accused of using illegal defeat device technology as a means of cheating emissions tests. But Volkswagen has since become just one among many car manufacturers to be subjected to such allegations, causing the scandal to soon become practically industry-wide. It’s July 2018, which means the new emissions laws have come into force to stop future Volkswagen style emissions scandals.
The new legislation, at the very least, acts as a far better deterrent to prevent future emissions scandals.

Will Volkswagen settle the emissions claims against them on the eve of trial?
In the UK and Europe, VW is refusing compensation to owners affected by their “dieselgate” scandal, despite the huge settlements they have agreed to in the US. Earlier this year, VW settled another case that was set for trial, and they reportedly did it on the eve of the case going to court.
Although we’re behind the US cases because the legal systems here in the UK are different, will we see a similar situation where VW settle the claims on the cusp of trial?

The recent court ruling that can allow German towns and cities to ban diesel vehicles was another example that attitudes are shifting as people are more aware of what automakers like Volkswagen are responsible for.
VW used cheat devices in around 11 million of their vehicles worldwide, and they did it (we assume) to allow their vehicles to pass emissions testing yet pollute more lethal NOx.
In our view, they put profits before people and they deserve to be punished. This latest buyback scheme in Germany, although limited, is one way they can help consumers affected by German law changes, and they should apply it universally for all consumers affected by the Emissions Scandal!

According to Unearthed, Greenpeace UK’s award-winning journalism project, the European “fix” for vehicles affected by the “dieselgate” scandal is nowhere near as effective as the US version.
As many of you already know,Volkswagen has offered compensation packages, buyback schemes and paid huge amounts of money in fines in the US, yet here in the UK they claim they have not broken any laws and are defiantly defending the legal case against them.
The news that the “fix” is less effective is another concern for European consumers who are still being refused compensation.
