Volkswagen had previously agreed to settle a group action lawsuit with a number of Canadian owners for selling them cars fitted with the so-called “defeat devices”, but this had not included owners of 3.0-litre vehicles. Now, a settlement has been finally reached in what is an unsurprising victory given that Volkswagen had already paid Canada’s neighbours in the U.S. billions of dollars in settlements and pay-outs, despite ignoring Europe.
Although owners of 2.0 litre engine Volkswagen group vehicles in Canada had their settlements sorted out fairly quickly, those who owned 3.0-litre Volkswagen, Audi and Porsche diesel vehicles had yet to see a penny until now.

A group of minority investors, who have reportedly seen their share values plummet as much as 40% when “dieselgate” hit the press, were initially refused a request for independent experts to investigate Volkswagen by the major shareholders. The minority shareholders reportedly took the disagreement to the German courts, and the Northern German appeal court has since allowed this group of Volkswagen investors to appoint an independent investigator to scrutinise what happened and who knew what about the emissions cheating scandal.
This potentially landmark investigation could uncover more about the senior staff and directors at the company who knew about the so-called “defeat devices” all along!

The High Court has set the next hearing for the end of March 2018 and crucial decisions will likely be made as to the direction of the VW Emission Litigation for victims in England and Wales.

In April 2017, MPs discussed the third report produced by the Transport Select Committee and the government’s response.

Could this be the right move towards compensation?
The pressure comes from several MPs on the Transport Select Committee (TSC) who slammed Volkswagen for turning their backs on U.K. consumers. Although Volkswagen admitted guilt in the U.S. and paid out billions of dollars, Volkswagen is still denying any liability here.
The TSC MPs are disgusted with the way Volkswagen are treating their U.K. consumers with “complete disregard”.

Although VW Canada has a settlement proposal on the table, the presiding judge has commented that it may not be in the best interests of the consumers.
On 31st March 2017 the Ontario Superior Court of Justice held an approval hearing for the 2.0 TDI litre vehicles aka the TDI Settlement Agreement applicable to Canada (outside of Quebec). This hearing followed a hearing on 22nd March in Quebec held by Justice Marie-Claude Lalande.
But the question now is whether this settlement will be good for the victims or not…

The VW Group initially set aside $18.2 billion (14.9 billion pounds) to pay for its wrongdoing in the emissions scandal.
However, the way these settlements are going, the German automakers will have to put their cheque-books on standby, as VW are set to pay-out another $4.3 billion (£3.5 billion) in the latest settlement.
There is, of course, our action here in the U.K. as well which will cost them a pretty penny too.

We’ve been made aware that Volkswagen, via their instructed solicitors dealing with the ongoing Volkswagen Emission Scandal (“dieselgate”), is refusing to cover dealers who may be losing millions as a result of the scandal.
It’s easy to see that the dealers could lose a fortune from unsold vehicles and being forced to lower prices as a result of any impact caused by the emissions scandal. It only seems fair that dealers – whether they’re general or independent dealers, or dealers who specifically only sell Volkswagen, Audi, SEAT, and Skoda vehicles – be compensated for their costs and losses.
Sadly, they’re in the same boat as the rest here in the UK, as it appears that Volkswagen UK are intent on not only refusing compensation to vehicle owners, but also to dealerships across the country too.

In the midst of a closing $14.7 billion settlement deal across the pond, the U.S. Federal Trade Commission (FTC) is obtaining approval from a federal judge to question the VW Group further in relation to evidence.
This is following allegations that the automaker deliberately destroyed documents in relation to the diesel scandal which, if found to be true, could have monumental consequences for the German automotive giants.
It’s now for the courts to decide whether VW did take part in such appalling action…
