VW have taken contrasting approaches when it comes to compensating their victims.
In the U.S., there has been a settlement of $15 billion approved by U.S. District Judge Charles Breyer in recent weeks. Yet, here in Europe, and in the rest of the world, VW continue to refuse to enter in to settlement negotiations.
Although the German car giants Volkswagen have admitted manipulating emissions management through the so-called “defeat device”, they have yet to provide compensation to affected vehicle owners in the EU area.
EU authorities have been in talks with Member States to discuss tactics to force a pay-out from VW, and we represent thousands of affected owners here in the UK, and we’re working with European lawyers on certain collaborative solutions.
As pressure continues to mount, we call for Volkswagen to do the right thing and start settlement talks with European customers as soon as they can, or we continue fighting them through the courts!

But there has been some encouraging news from mainland Europe, as a court in Valladolid has ruled in favour of a buyer involved in the ongoing emissions scandal. The Spanish Courts ordered VW to pay 5,000 Euros on top of a repair of the vehicle, which is great to hear.

U.S. District Judge Charles Breyer is likely to approve of the settlement offer made by VW in the cheating emissions scandal
The never-ending Volkswagen saga could be coming to a head in the U.S. as Judge Charles Breyer is set to approve the proposed $10 billion settlement in the U.S.
The settlement proposal is offered to all affected victims in the U.S. of VW’s use of the so-called “defeat device” software in the 2.0 litre diesel vehicles. The alleged “defeat device” allowed diesel vehicles to pollute 40 times more NOx emission than the legal limit, and the decision is a long-awaited judgment that should see affected victims in the U.S. finally get the justice they deserve.

The blows for Volkswagen don’t seem to end.
In August, Italy’s Antitrust Authority (AGCOM) fined the German manufacturer 5 million Euros.
The authority are alleging that VW misinformed vehicle owners of the real diesel emissions results. The case concerns vehicles sold by VW between 2009 and 2015, but includes Audi, Seat and Skoda.

The big news back in April this year was that VW would reach a final settlement in the U.S, and Dietmar Voggenreiter, Audi’s global head of sales and marketing, has discussed that a ‘final’ settlement may well be on the table for this month or early November.
VW’s massive payout comes from them cheating emissions scandal that emerged in September 2015 when they were found to be using so-called ‘defeat devices’ which affected 11 million vehicles worldwide. VW have (in a fashion) admitted to cheating the tests using software that could switch off emissions controls when vehicles were not being tested.
Since then, VW U.S. has decided to make settlement payments to their affected customers.

In the midst of all the tension surrounding the Volkswagen Emissions Scandal, fresh claims have been made that VW has violated two EU Consumer Directives – specifically, the Consumer Sales and Guarantees Directive, and the Unfair Commercial Practices Directive – in 20 European countries.
The first directive is put in place to prevent companies like VW from exaggerating environmental claims when marketing their products. This is, arguably, exactly what VW did when they marketed the vehicles as “green” that instead had “defeat devices” installed in them. Their ‘false advertising’ was used for seven years or so with suggestions of their diesel engines being “clean diesel” engines.

German regulators have reportedly approved a fix for 1.2L Volkswagen Group models affected by the emissions scandal – dubbed “dieselgate” in the media.
The fix has been approved for some five million vehicles affected, which accounts for almost half of those affected across the globe, and includes models like the SEAT Ibiza and the Volkswagen Polo.
The fix may be approved, but the question as to how the fix is going to affect vehicles moving forward remains the important one.

Between 2009 and 2015 Volkswagen installed software on models which allowed them to cheat pollution testing, making their cars appear more environment friendly. The software, aka as ‘defeat devices’, allowed the cars to pass emissions tests by switching on the emissions control software when under test conditions. When the car was not being tested, the software was switched off, and the cars emitted up to 40 times more nitrogen oxide.
Only certain models were fitted with the defeat device, but it is thought around 11 million cars had the device installed over the six year period.
The German car makers are offering US car owners up $10,000 each in compensation; but so far, they are yet to offer deals to any other countries.

Campaigners say that the British government is wrongfully failing to investigate pollution levels from vehicles in the aftermath of the Volkswagen Emissions Scandal.
