Following a monumental four-year legal battle, the UK Supreme Court has ruled in favour of Your Lawyers after a lengthy appeal case against Harcus Sinclair was concluded. The case initially arose from an agreement signed by the two firms in relation to the Volkswagen emissions litigation.

Unfortunately, Harcus Sinclair subsequently failed to honour the agreement made with Your Lawyers. Your Lawyers has been trading as The Car Emissions Lawyers since 2015 when news of the first “dieselgate” scandal hit the headlines, representing thousands of owners claiming against a range of carmakers in England and Wales.

Aman Johal, lawyer and director of Your Lawyers (The Car Emissions Lawyers), expressed his relief at the ruling: “This is such an important victory for Your Lawyers but also for the dignity and sanctity of the legal profession. We have lived and breathed this case for four long years and were forced to take the matter all the way to the UK Supreme Court simply to oblige a law firm to honour an agreement that they freely entered into.”

Your Lawyers, Harcus Sinclair and the Volkswagen emissions litigation

In the early stages of the Volkswagen emissions litigation, Your Lawyers consulted with Harcus Sinclair regarding the case and the action moving forward. As part of this, Harcus Sinclair freely signed an agreement in anticipation of the firms moving forward with a collaborative effort in the action.

Unfortunately, Harcus Sinclair went on to breach the agreement made with Your Lawyers, and the matter ended up in the Supreme Court.

What does the Supreme Court victory mean?

At the Supreme Court, Harcus Sinclair argued that it was unreasonable to hold them to the agreement that had been signed in respect of a non-compete clause. The matter went to the Supreme Court as the highest court in the land, and we are pleased that the Supreme Court unanimously ruled in favour of Your Lawyers on the matter of the non-compete clause in the agreement established.

Now, we can move forward and continue to fight for the rights of the thousands of people who may have been affected by the actions of a number of carmakers as part of the wider “dieselgate” emissions scandals.

The emissions litigations continue

Your Lawyers – trading as The Car Emissions Lawyers – has been fighting for the rights of those who may have been wronged by carmakers involved in the “dieselgate” scandals since the original one involving VW came to light in 2015. The first case was the Volkswagen emissions litigation with the Group Litigation Order (GLO) being established in 2018, and Your Lawyers were previously appointed to the Steering Committee for this action. Since then, we have taken forward many more claims against many more carmakers with the VW GLO now closed for new claimants.

Carmakers who are also alleged to have been involved in behaviour that could have resulted in emissions test cheating include Mercedes, Nissan, Renault, Ford, and BMW, to name just a few. Carmakers continue to deny that they have done anything wrong, and we continue to investigate claims on behalf of our clients to get to the bottom of the allegations that they are all facing.
