Your Lawyers – T/A The Car Emissions Lawyers – is investigating allegations that the Fiat Chrysler Automobiles (FCA) group, which includes the brands Alfa Romeo, Chrysler, Dodge, Jeep, Lancia, Maserati, and Ram Trucks, could be involved in the use of illegal “defeat device” technology.
The company, controlled by holding company Exor, has recently been involved in raids across several countries in Europe. In the US last year, it was announced that Fiat Chrysler Automobiles would pay $800 million to resolve emissions claims involving the use of allegedly illegal software.
A senior manager also faced federal charges following the multi-million-dollar settlement as well.
Information about the specific models that could be affected is yet to be properly established. It is suspected that there may be some 200,000 vehicles affected in Germany alone that were manufactured between 2014 and 2019 and were fitted with Euro 5 and Euro 6 engine types. This may include 1.3, 1.6 and 2.0 litre vehicle “Multijet” engines, but others should not be ruled out until further clarification has been established.
This latest potential emissions scandal comes just weeks after Your Lawyers increased its efforts on the ongoing Mercedes-Benz emissions compensation action, with a huge number of owners coming forward for help. It also comes as Nissan Renault face similar allegations over the alleged use of technology that could amount to a “defeat device” arising from emissions irregularities.
In July 2020, it was revealed that authorities in Fiat’s home base of Italy, as well as authorities in Germany and Switzerland, conducted raids at FCA offices. The raids, coordinated by EUROJUST, relate to allegations that Fiat-Chrysler is another carmaker that may be using illegal technology that could amount to a “defeat device” to cheat emissions regulations.
In the UK, it is understood that authorities here have contacted two offices in London with requests for documentation over Fiat Emissions matters. CNH Industrial, which encompasses truck maker Iveco, is another company under the control of the same holding company as Fiat-Chrysler (Exor) and is also understood to have been involved in the raids.
Both companies are said to be cooperating with authorities.
In 2016, representatives from Your Lawyers attended a conference in Brussels in the wake of the VW Emissions Scandal the firm has been heavily involved with. The matter of whether Fiat-Chrysler was involved in any behaviour that needed to be more closely scrutinised was discussed, but authorities at that stage had not sought to take any action. As such, the recent raids do not come as a surprise to us and is welcome news as we continue to hold any carmaker to account that is found to have been involved in cheating emissions regulations.
Like other carmakers, we fully expect Fiat-Chrysler to deny any wrongdoing. If this is the case, we will pursue an action to establish if the use of “defeat device” technology has been used. In the earlier VW emissions action, the High Court recently confirmed that the German automotive giant had used defeat device technology that is illegal under UK and EU law.
